Who is in the right/wrong?

The car that hit you is to blame for any damage to your car. The Highway code tells drivers to drive behind a nother vehicle with a safe distance between you in case the other car in front has to brake in an emergency. it horrifies me when I see cars driven in the fast lane of a motorway being tailgated by the driver behind them. Do they ever think what can happen if the car in front had a tyre blowout or his engine suddenly cut out.
